Location: lax
Call #: KF505 .D54 2013
Publisher:

The rise in divorce, cohabitation, single parenthood and same-sex partnerships along with an increase in surrogacy, adoption and assisted reproductive technologies has led to many diverse configurations of families, or intimate associations. The authors show that children of married parents fare better than children in a household formed by cohabiting adults. This is not to condemn non-traditional families but to point out that society and the law do not adequately provide for their needs. In conclusion, they call for a legal system that can adapt to the continually changing reality of family life. Find out more (catalog link)

Critical studies in private law : a treatise on need-rational principles in modern law / Thomas Wilhelmsson.

Location: lacom
Call #: KJT858 .W5513 1992
Publisher: Kluwer Academic Publishers,

Critical Studies in Private Law discusses the prerequisites and possibilities for an alternative or critical legal dogmatics. The starting point of the analysis is the recognition of contradictions within the legal order. In this respect the theory may use the experience of both American Critical Legal Studies and the German attempts to formulate a legal theory for the social state. The key for understanding how the contradictory concrete legal material may produce varying results on the level of legal decisions is the systematization, the general principles of the law. Critics of alimony claim it has no place in contemporary visions of marriage as a partnership of equals. But as Cynthia Lee Starnes argues in The Marriage Buyout, alimony is often the only practical tool for ensuring that divorce does not treat today's primary caregivers as if they were suckers. Her solution is to radically reconceptualize alimony as a marriage buyout.Starnes's buyouts draw on a partnership model of marriage that reinforces communal norms of marriage, providing a gender-neutral alternative to alimony that assumes equality in spousal contribution, responsibility, and right. Warnings and product liability : lessons learned from cognitive psychology and ergonomics / Sanne Pape.

Location: lax
Call #: KJE1630 .P37 2012
Publisher:

European Union citizens are injured each year while using products. Product liability law can contribute to preventing such damage by the way in which liability requirements in the context of warnings are framed and applied. Underlying these warning issues are a number of legal presumptions about how humans behave and interact with products and with their warnings. Primarily, liability law presumes that warnings can be effective in modifying user behavior. Relative to this is the manner in which courts or litigants evaluate product warnings in European product liability law. To rule more consistently and effectively in warning issues, a solution resides in the use of guidelines in European product liability laws that are based on empirical evidence on how humans interact with warnings. This book undertakes a behavioral approach towards the topic of warnings and product liability. Find out more (catalog link)
