Law as a tool for empowering women within marital relations : a case study of paternity lawsuits in Egypt / Hind Ahmed Zaki.

Location: lacom
Call #: KRM1749 .A94 2012
Publisher: American University in Cairo Press,

How do women use courts within the context of paternity lawsuits? This study analyzes the challenges that the formal legal approach to empowering women faces once it is translated into everyday socio-legal experiences and court repertoires. It also seeks to trace the pathologies inherent inpersonal status law reform and normal legal practices in Egypt, attesting to the limitations of law as an agent of social change in the private domain of the family. It mainly sheds light on the difficulties of separating formal legal rules from informal social practices. It also explores the problem of paternity claims in Egypt. Adding to growing literature on the use of legal mobilization to advance gender equity, this study offers insights on theoften-neglected role of social norms in court experiences, often leading to unexpected consequences that sometimes defy the intended goals behind policies and legislation. Although discussion has frequently focused on the role Islamic family law should have in these countries, this book seeks to set that discussion within a wider context that includes consideration both of theoretical issues and also of empirical data about the interaction between specific family practices and state law in a variety of jurisdictions ranging from England and Wales to Bangladesh, Botswana, Spain, Poland, France, Israel, Iran and South Africa. Transferable groundwater rights : integrating hydrogeology, law and economics / Andreas N. Charalambous.

Location: lax
Call #: K3496 .C48 2013
Publisher:

The principle of Transferable Water Rights (TWR) is that by making water rights capable of being traded in the market, water resources can be used more sustainably and efficiently. Water would achieve its economic value, by switching from the high volume-low value irrigation, which is prevalent with many farmers, to low volume-high value urban supply or the growing of intensive horticultural or cash crops. However, sceptics point out that free markets do not usually best serve the environment, the poor and the conservation of resources. This book discusses TWR in their broader context. According to our hearts : Rhinelander v. Rhinelander and the law of the multiracial family / Angela Onwuachi-Willig.

Location: lax
Call #: KF228.R47 O59 2013
Publisher:

This landmark book looks at what it means to be a multiracial couple in the United States today.According to Our Hearts begins with a look back at a 1925 case in which a two-month marriage ends with a man suing his wife for misrepresentation of her race, and shows how our society has yet to come to terms with interracial marriage. Angela Onwuachi-Willig examines the issue by drawing from a variety of sources, including her own experiences. She argues that housing law, family law, and employment law fail, in important ways, to protect multiracial couples. In a society in which marriage is used to give, withhold, and take away status in the workplace and elsewhere she says interracial couples are at a disadvantage, which is only exacerbated by current law. Contributors to Signposts explore a wide range of subjects related to southern constitutional and legal thought, including real and personal property, civil rights, higher education, gender, secession, reapportionment, prohibition, lynching, legal institutions such as the grand jury, and conflicts between bench and bar. Outsourcing justice : the rise of modern Arbitration laws in America / Imre Szalai.

Location: lax
Call #: KF9085 .S98 2013
Publisher: Carolina Academic Press,

Arbitration is a method of dispute resolution in which parties agree to submit their dispute to a private, neutral third person, instead of a traditional court with a judge and jury. This private system of arbitration, which is often confidential and secretive, can be a polar opposite, in almost every way, to the public court system. Over the past few decades, arbitration agreements have proliferated throughout American society. Such agreements appear in virtually all types of consumer transactions, and millions of American workers are bound by arbitration agreements in their employment relationships. America has become an "arbitration nation," with an increasing number of disputes taken away from the traditional, open court system and relegated to a private, secretive system of justice. How did arbitration agreements become so widespread, and enforceable, in American society? Find out more (catalog link)

Large-scale arbitration has since spread beyond US borders, with collective arbitration being seen in Europe and mass arbitration being used in the international investment regime. This title considers all three forms of arbitration as a matter of domestic and international law, providing arbitrators, advocates and scholars with the tools they need to evaluate these sorts of procedural mechanisms. Location: lax
Call #: E185.61 .W18 2013

Wallace explores the role and methods of media suppression in the South during the civil rights movement and the southern "massive resistance" to integration. Segregationists understood the importance of public opinion to defending their social system, and, as a result, desperately fought to influence how the civil rights movement and segregation were defined for the nation. However, when certain national news coverage and the voices of a minority of southern journalists challenged the growing massive resistance extremism and the arguments used to preserve the "southern way of life," segregationists responded with organized attempts to silence criticism, dissent and public debate within the press. Defining the struggle : national organizing for racial justice, 1880-1915 / Susan D. Carle.

Location: lax
Call #: KF4757 .C37 2013
Publisher:

Since its founding in 1910--the same year as another national organization devoted to the economic and social welfare aspects of race advancement, the National Urban League--the NAACP has been viewed as the vanguard national civil rights organization in American history. But these two flagship institutions were not the first important national organizations devoted to advancing the cause of racial justice. Instead, it was even earlier groups -- including theNational Afro American League, the National Afro American Council, the National Association of Colored Women, and the Niagara Movement - that developed and transmitted to the NAACP and National Urban League foundational ideas about law and lawyering that these latter organizations would then pursue. With unparalleled scholarly depth, Defining the Struggle explores these forerunner organizations whose contributions in shaping early twentieth century national civil rights organizing have largely been forgotten today. It examines the motivations of their leaders, the initiatives they undertook, and the ideas about law and racial justice activism they developed and passed on to future generations. The rise in divorce, cohabitation, single parenthood and same-sex partnerships along with an increase in surrogacy, adoption and assisted reproductive technologies has led to many diverse configurations of families, or intimate associations. The authors show that children of married parents fare better than children in a household formed by cohabiting adults. This is not to condemn non-traditional families but to point out that society and the law do not adequately provide for their needs. In conclusion, they call for a legal system that can adapt to the continually changing reality of family life. Find out more (catalog link)

Publisher: Kluwer Academic Publishers,

Critical Studies in Private Law discusses the prerequisites and possibilities for an alternative or critical legal dogmatics. The starting point of the analysis is the recognition of contradictions within the legal order. In this respect the theory may use the experience of both American Critical Legal Studies and the German attempts to formulate a legal theory for the social state. The key for understanding how the contradictory concrete legal material may produce varying results on the level of legal decisions is the systematization, the general principles of the law. Her solution is to radically reconceptualize alimony as a marriage buyout.Starnes's buyouts draw on a partnership model of marriage that reinforces communal norms of marriage, providing a gender-neutral alternative to alimony that assumes equality in spousal contribution, responsibility, and right. Underlying these warning issues are a number of legal presumptions about how humans behave and interact with products and with their warnings. Primarily, liability law presumes that warnings can be effective in modifying user behavior. Relative to this is the manner in which courts or litigants evaluate product warnings in European product liability law. To rule more consistently and effectively in warning issues, a solution resides in the use of guidelines in European product liability laws that are based on empirical evidence on how humans interact with warnings. This book undertakes a behavioral approach towards the topic of warnings and product liability. Find out more (catalog link)
