Banking secrecy and offshore financial centers : money laundering and offshore banking / Mary Alice Young.
Location:
lax
Call #:
K5223 .Y68 2013
Publisher:
Routledge,
This book brings together the issues surrounding banking secrecy and confiscation of criminal proceeds. The book examines the existing legal agreements at the international, regional and national levels and their interaction in the substantive areas of confiscation, anti-money laundering and banking confidentiality laws. It looks at how these agreements have been applied in offshore financial centres and demonstrates that despite a number of legally binding UN Conventions as well as global anti-money laundering recommendations, the implementation of them is often lukewarm by those Parties who have ratified the Convention and adopted obligations, because of this the confiscation legislation is incompatible with strict banking confidentiality laws. The work draws on the experience of criminologists to offer critical insight into the legislative frameworks designed to deal with banking secrecy and confiscation in offshore financial centres. It goes on to offer suggestions for measures that may be taken by major economies to circumvent the lack of cooperation by offshore financial centres as intolerance towards money laundering grows in light of recent political and economic events.

Domestic judicial review of trade remedies : experiences of the most active WTO members / Edited by Muslum Yilmaz.
Location:
lax
Call #:
K3943 .D655 2012
Publisher:
Cambridge University Press,
rade remedies, namely anti-dumping, countervailing measures and safeguards, are one of the most controversial issues in today's global trading environment. When used, such measures effectively close the markets of the importing countries to competition from outside for a certain period of time. Exporters that are faced with such measures can either try to convince their government to bring a case against the government of the importing country in the WTO or to use, themselves, the judicial review mechanism of the importing country. This second path has been, until now, largely unexamined. Domestic Judicial Review of Trade Remedies is the first book of its kind to examine in detail how the judicial review process has functioned and considers the experiences in the domestic courts of the twenty-one WTO members that are the biggest users of trade remedies.

Call #:
K4475 .E33 2012
Publisher:
The financial crisis which engulfed global markets in 2008 created an acute need for improved international economic cooperation. Despite the G20s prominent coordination role, the regulatory response to the crisis has varied considerably across governance arenas. This book focuses on the international tax arena and examines how the financial crisis prompted renewed attempts to enhance international tax transparency. It highlights the complexity of international regime change and the significance of national and financial interests, international organizations, domestic politics and the emerging G20 Leader's Forum in this process.

International investment law and soft law / edited by Andrea K. Bjorklund, August Reinisch.
Location:
lax
Call #:
K3830 .I5953 2012
Publisher:
Edward Elgar Pub.,
This important book examines the development of soft law instruments in international investment law and the feasibility of a 'codification' of the present state of this field of international economic law. It draws together the views of international experts on the use of soft law in international law generally and in discrete fields such as WTO, commercial, and environmental law. The book assesses whether investment law has sufficiently coalesced over the last 50 years to be 'codified' and focuses particularly on topical issues such as most-favoured-nation treatment and expropriation. This timely book will appeal to academics interested in the development of international law and legal theory, to those working in investment law, Government investment treaty negotiators and arbitration practitioners.

Principles of international investment law / Rudolf Dolzer and Christoph Schreuer.
Location:
lax
Call #:
K3830 .D65 2012
Publisher:
This book outlines the principles behind the international law of foreign investment. The main focus is on the law governed by bilateral and multilateral investment treaties. It traces the purpose, context, and evolution of the clauses and provisions characteristic of contemporary investmenttreaties, and analyses the case law, interpreting the issues raised by standard clauses. Particular consideration is given to broad treaty-rules whose understanding in practice has mainly been shaped by their interpretation and application by international tribunals. In addition, the book introducesthe dispute settlement mechanisms for enforcing investment law, outlining the operation of Investor vs State arbitration.Combining a systematic analytical study of the texts and principles underlying investment law with a jurisprudential analysis of the case law arising in international tribunals, this book offers an ideal introduction to the principles of international investment law and arbitration, for students or practitioners alike.

Taxation : a fieldwork research handbook / edited by Lynne Oats.
Location:
lax
Call #:
HJ2305 .T1865 2012
Publisher:
Routledge,
Taxation is a subject of enquiry that cuts across a range of disciplines, including law, economics, politics, psychology, history and accountancy, to name a few. However, research into taxation as a social and institutional phenomenon – rather than as abstraction from the real world – is largely neglected.
Taxation: A Fieldwork Research Handbook opens up new avenues of enquiry in the research of taxation by offering suggestions on how research might be conducted into actual tax practice, rather than abstract models.
