Location:
lax
Call #:
K2400 .R88 2013
Publisher:
Cambridge University Press,
Arbitration has become an increasingly important mechanism for dispute resolution, both in the domestic and international setting. Despite its importance as a form of state-sanctioned dispute resolution, it has largely remained outside the spotlight of constitutional law. This landmark work represents one of the first attempts to synthesize the fields of arbitration law and constitutional law. Drawing on the author's extensive experience as a scholar in arbitration law who has lectured and studied around the world, the book offers unique insights into how arbitration law implicates issues such as separation of powers, federalism, and individual liberties.

Call #:
KF808 .R25 2013
Publisher:
Princeton University Press,
Boilerplate--the fine-print terms and conditions that we become subject to when we click "I agree" online, rent an apartment, enter an employment contract, sign up for a cellphone carrier, or buy travel tickets--pervades all aspects of our modern lives. On a daily basis, most of us accept boilerplate provisions without realizing that should a dispute arise about a purchased good or service, the nonnegotiable boilerplate terms can deprive us of our right to jury trial and relieve providers of responsibility for harm.Boilerplateis the first comprehensive treatment of the problems posed by the increasing use of these terms, demonstrating how their use has degraded traditional notions of consent, agreement, and contract, and sacrificed core rights whose loss threatens the democratic order.

Publisher:
Oxford University Press,
This first volume in theOxford International and Comparative Insolvency Law Series addresses the types, conditions, participants and effects of insolvency proceedings. It deals with the commencement of insolvency proceedings over business debtors and with their effects on the various players, assets and liabilities concerned.
The uniform treatment of topics allows detailed comparisons to be made which helps practitioners seek foreign counsel on specific features of a foreign legal system and for academics the book provides a wealth of previously inaccessible material. All major legal families (including various mixed legal systems) are covered to reflect the needs of the international insolvency community and intergovernmental organizations.
This is the only book that offers a thorough comparative analysis of existing domestic insolvency laws in the main economically developed and emerging countries and meets the need for detailed analysis on largely inaccessible materials in English.

Confidentiality, transparency, and the U.S. civil justice system / edited by Joseph W. Doherty, Robert T. Reville, Laura Zakaras.
Location:
lax
Call #:
KF8700 .C658 2012
Publisher:
Oxford University Press,
American law was founded on the principle of an open court, where the general public could observe judicial proceedings and report to others on the outcomes. In recent decades, however, civil disputes have been increasingly resolved out of court, with the outcomes of the disputes kept secret. While it is widely acknowledged that confidential handling of disputes has advantages, these trends reduce the transparency of the entire civil justice system. This collection of articles considers whether reversing this trend should be a public policy objective. With special attention to modern mass litigation, leading legal scholars provide empirical, nonpartisan, and multidisciplinary analyses, case studies, and novel prescriptions for reform of various aspects of the system.

Publisher:
Harvard University Press,
Addressing a host of hot-button issues, from the barring of Christian student groups and military recruiters from law schools and universities to churches’ immunity from civil rights legislation in hiring and firing ministers, Paul Horwitz proposes a radical reformation of First Amendment law. Arguing that rigidly doctrinal approaches can’t account for messy, real-world situations, he suggests that the courts loosen their reins and let those institutions with a stake in First Amendment freedoms do more of the work of enforcing them.

Law as a tool for empowering women within marital relations : a case study of paternity lawsuits in Egypt / Hind Ahmed Zaki.
Location:

Call #:
KRM1749 .A94 2012
Publisher:
American University in Cairo Press,
How do women use courts within the context of paternity lawsuits? This study analyzes the challenges that the formal legal approach to empowering women faces once it is translated into everyday socio-legal experiences and court repertoires. It also seeks to trace the pathologies inherent inpersonal status law reform and normal legal practices in Egypt, attesting to the limitations of law as an agent of social change in the private domain of the family. It mainly sheds light on the difficulties of separating formal legal rules from informal social practices. It also explores the problem of paternity claims in Egypt. Adding to growing literature on the use of legal mobilization to advance gender equity, this study offers insights on theoften-neglected role of social norms in court experiences, often leading to unexpected consequences that sometimes defy the intended goals behind policies and legislation.

This is not civil rights : discovering rights talk in 1939 America / George I. Lovell.
Location:

Call #:
KF4749 .L68 2012
Publisher:
The University of Chicago Press,
Since at least the time of Tocqueville, observers have noted that Americans draw on the language of rights when expressing dissatisfaction with political and social conditions. As the US confronts a complicated set of 21st century problems, that tradition continues, with Americans invoking symbolic events of the founding era to frame calls for change. Most observers have been critical of such 'rights talk'. Scholars on the left worry that it limits the range of political demands to those that can be articulated as legally recognised rights, while conservatives fear that it creates unrealistic expectations of entitlement. Drawing on a cache of Depression-era complaint letters written by ordinary Americans to the Justice Department, George I. Lovell challenges these common claims.
