"The America Invents Act’s Post Issuance Patent Challenge Regimes -- IPR, PGR, CBM: A Comparative Empirical Perspective from Japan"
With the passage of the America Invents Act ("AIA") and the subsequent implementation of its post-issuance patent challenge mechanisms (inter partes review ("IPR"), post-grant review ("PGR"), and covered business method ("CBM")), we are faced with new options and strategies concerning patent invalidation. Professor Jay Kesan will discuss these strategies and the possibilities for future reform and modifications of these regimes. Since these AIA regimes raise the possibility of dual decisions on patent invalidation by both the district courts and the U.S. Patent and Trademark Office, Professor Kesan will present comparative empirical data from Japan on outcomes when the same patents were challenged in the Japan Patent Office and the patent district courts.
